Terms of Service
Published Winch legal document. This version is the current Terms of Service for the Winch Legal / Trust platform.
These Terms of Service describe the rules for accessing and using Winch products, websites, applications, APIs, and related services.
Service
Winch provides AI-assisted commerce infrastructure that helps merchants connect operational systems, configure AI sales agents, and support buyer conversations, quotes, documents, and order workflows.
Accounts and access
Users are responsible for keeping account access secure and for ensuring that only authorized people use their workspace. Organization owners and administrators are responsible for managing members, roles, and access to company data.
Customer data
Customers remain responsible for the data, instructions, catalog information, business rules, and documents they provide to Winch. Winch processes customer data to provide, secure, maintain, and improve the service according to the applicable agreement and privacy documentation.
AI outputs
Winch uses AI systems that may generate incomplete, inaccurate, or unexpected outputs. Customers are responsible for configuring appropriate business rules, reviewing important decisions, and deciding when human review is required.
Acceptable use
Users must not use Winch to violate laws, infringe rights, bypass security controls, misrepresent products or prices, send unlawful communications, or process data they are not authorized to process.
Billing and trials
Paid plans, trials, usage limits, and billing terms are described in the applicable product, order, or billing pages. Customers are responsible for paying applicable fees and taxes.
Availability and changes
Winch may change, improve, suspend, or discontinue parts of the service. Winch aims to provide reliable service but does not guarantee uninterrupted or error-free operation.
Liability
To the maximum extent permitted by law, Winch is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business opportunities.
Termination
Winch may suspend or terminate access if a user violates these Terms, creates security or legal risk, or fails to meet payment obligations. Customers may stop using the service according to the applicable plan or agreement.
Changes to these Terms
Winch may update these Terms. Material changes may be notified by email, in-app notice, or another appropriate method. Continued use after the effective date may require acceptance of the updated version.
